This “Terms of Use” (“Terms”) provides fundamental matters regarding use of various services provided in the Website (the “Services”).

Article 6: Prohibited Matters

In using the Website, the Users are prohibited by SHISEIDO from conducting the following acts (including acts or preparatory acts which may trigger the following acts):

1. Any act that defames or slanders, or may defame or slander, other Users, third parties and/or SHISEIDO (including SHISEIDO's affiliated companies);
2. Any act that infringes or may infringe property rights or privacy of other Users, third parties and/or SHISEIDO (including SHISEIDO's affiliated companies);
3. Any act that infringes or may infringe intellectual property rights (including, but not limited to, copyrights, design rights, patent rights, utility model rights, trademark rights and portrait rights) of other Users, third parties and/or SHISEIDO (including SHISEIDO's affiliated companies);
4. Any act to transmit or write harmful computer programs;
5. Any act that offends or may offend public order and morals or that constitutes or may constitute criminal behavior;
6. Any act to use or to be prepared to use the Services for commercial purposes;
7. An election campaign or any similar act, or any other act that relates to politics and/or religions;
8. Any other act that hinders operation of the Services;or
9. Any act that violates any law or regulation of Hong Kong or of a country or district in which the User is residing at the time of use of the Website.

Article 7: Responsibility regarding Use of Information provided in Website

SHISEIDO will make no guarantee of the integrity and availability of the information which the Users obtain through the Website, including information dispatched from other Users. All Users will make use of the Website on their own responsibility and judgment, and SHISEIDO will not be held responsible for any result of using or relying on such information.

Article 8: Copyright and other Intellectual Property

1. Any right relating to all the content of the Website belongs to or is exercised by SHISEIDO under the license and other legitimate title, and no part of the Website may be used for any purpose other than personal use, redelivered to the public, or used or reproduced by the Users without permission, whether in or outside of the network.
2. All trademarks and service marks appearing on the Website are owned, or used under the license and other legitimate title by SHISEIDO or its affiliated companies, and the Users are prohibited from using any such trademarks and service marks without permission of SHISEIDO.
3. Any copyright or other intellectual property right arising from or in connection with information provided by the Users (including the rights provided for in Article 27 and Article 28 of the Copyright Act) shall be transferred from the Users to SHISEIDO without charge, and the Users shall not exercise the moral rights of author or any other similar rights whatsoever.

Article 9: Change, Addition and Termination of Services

1. In any of the following events, SHISEIDO may terminate or temporarily suspend the provision of all or part of the Services without giving prior notice to the Users

(1) In the event of regular or urgent maintenance of the systems that provide the Services;

(2) In the event that there are other reasonable grounds in respect of the operation or technology of the Services.

(3) In the event of a power outage, fire, earthquake or any other force majeure that makes provision of the Services difficult; or

(4) In the event of a failure of the systems that provide the Services;

2. SHISEIDO may make a change or addition to or terminate all or part of the Services without prior notice to the Users.
3. SHISEIDO will not be held liable for any detriment or damage incurred by the Users as a result of any of the preceding actions.

Article 10: Websites of Third Parties

SHISEIDO will not be held responsible for and will not be liable to compensate for any damage arising from or in connection with the use of other website managed or operated by third parties that are linked from the Website.

Article 11: Handling of Personal Information

1. As a general rule, Users are not required to provide any personal information, such as addresses or names, which could be used to identify the User (collectively, “Personal Information”), in order to access and view these Website.
2. SHISEIDO will appropriately manage all Personal Information in accordance with our "Privacy Notice".

Article 12: Indemnity and Compensation for Damages

1. If any of the Users violates these Terms or inflicts damage on SHISEIDO by fraudulent acts, SHISEIDO may claim reasonable compensation against such User. The Users who, by using the Services, inflict damage on third parties shall settle such damage on their own responsibility.
2. Unless otherwise provided herein, SHISEIDO will not be held responsible to the Users or third parties for any failure or breakdown of the systems that provide the Services, any intrusion to the Systems by third parties and any commercial disputes for any reason whatsoever.

This Website makes use of following highly secure technologies, and maintaining a high level of security.

1. The Users may freely establish a link to the Website in their own website, except for those which include:

Article 15: Governing Law / Jurisdiction

Any interpretation and application of the Website and these Terms shall be governed by the laws of Hong Kong Special Administrative Region (HKSAR). Unless otherwise provided, any and all disputes arising from or in connection with the Website shall be subject to the exclusive jurisdiction of the Hong Kong courts as the court of first instance.

Shiseido Group, Shiseido Co., Ltd. and SHISEIDO Hong Kong Limited (referred to collectively as “Shiseido”, “we”, “our” or “us”) respect your legal rights of privacy when collecting, holding, storing, using, processing, transmitting or otherwise handling personal data and this Privacy Policy Statement explains our privacy practices. We are committed to comply with the requirements under the Personal Data (Privacy) Ordinance, Chapter 486 of the Laws of the Hong Kong Special Administrative Region. Your personal data may be collected when you make a purchase, participate in promotional activities or apply to be a member of any of the brands of fragrance, cosmetics, beauty care and related products operated by us from time to time, including but not limited to Anessa, Bare Minerals, Clé de Peau Beauté, Dolce & Gabbana Beauty, Elie Saab Parfums, Ettusais, Fino, Ipsa, Issey Miyake Parfums, Laura Mercier, Ma Chérie, Majolica Majorca, Nars, Narcisco Rodriguez Parfums, Senka, Serge Lutens, SHISEIDO, Tsubaki, Za and Zadig & Voltaire Parfums.
Certain personal data is required to be provided on an obligatory basis if you wish to receive certain services from us. These data will be marked as “mandatory” in the Member Record Form and you MUST provide your personal data to us if you want us to provide the service for which you are applying. If personal data is only required on a voluntary basis, it will not be marked “mandatory” and it is entirely up to you to decide whether you want to provide such information to us or not.
Your supply of personal data is mandatory if you wish to receive one or more of the following services:
(a) Enrolment into and maintaining your membership as our member;
(b) Accumulating bonus points as our member;
(c) Communicating to you your entitlements and privileges as our member;
(d) Redemption of privileges as a member;
(e) Notification of any amendment to the membership program;
(f) Data cleansing and customers profile updates; and
(g) Other continuous customer support services directly in relation to your membership.
We may use any personal data provided by you (whether on an obligatory and/or voluntary basis) to enable us to provide the following additional services to you and/or carry out the following activities:
(a) To enable us better to understand the demographics of our customers;
(b) For internal research and analysis to enable us to provide rewards, services and product information or offerings better tailored to your needs;

(d) To enable our beauty consultant/specialist to follow up;
(e) To distribute customer satisfaction survey; and
(f) To send our VIP newsletters and VIP program updates.

4. Disclosure of Personal Data

In cases where we do collect personal data from you, we will:
(a) Inform you (by way of this Privacy Policy Statement or by a separate notification) that we are doing so and the purpose(s) for which we will use the personal data collected;
(b) Where relevant, give you the opportunity to opt-out and object to any of the purpose(s) for which we will use the personal data collected (including but not limited to the circumstances described in paragraph 5 below); and

(d) Government, judicial or regulatory authorities, law enforcement agencies or other organizations as required or authorized by applicable laws in or outside Hong Kong.
Our Third Party Service Providers are under a duty of confidentiality and are contractually bound to protect your personal data privacy and to only use your personal data in connection with the purposes specified in paragraph 3 above and not for their own purposes (including direct marketing).

5. Use of Data in Direct Marketing

We may also use your personal data including name, telephone number, address and email for direct marketing. By law, we may not use your personal data for this purpose unless we have received your consent (including an indication of no objection).
Upon your consent, your personal data may be used for:
(a) Communicating to you regarding new product launch and other promotional offers, including where applicable, skincare products, cosmetics products, make up products, body care products, make up services, body care services and facial services;(b) Communicating to you regarding our promotional events including where applicable, makeup classes and/or demonstrations, skincare seminars, other beauty classes, PR events, VIP gatherings, value sets, shop opening events, store announcement/ events, exhibitions and news update;
(c) Communicating on-counter or out of counter services and events related to skincare, makeup or beauty services for promotion or rewarded purpose;
(d) Marketing reward programs, birthday celebration offers, free sampling, digital campaigns, roadshow/ outpost, in store promotion updates;
(e) Communicating joint promotion or events with shopping malls, department stores, credit cards, banks, trades, celebrities, magazines, television, websites, mileage programs, cultural, art or musical societies/ organizations, charities or nonprofit organizations; and
(f) Cross brand joint promotions and/ or events with brands within SHISEIDO.
If at any other point of time you do not wish us to use your personal data for use in direct marketing as described above, you may exercise your opt-out rights by notifying us through the communication channels as stated in paragraph 7 below.

6. Security

All personal data provided by you will be properly stored in our customer service system and can only be accessed by authorized persons who have received training on our privacy policies.

Cookies are small, often encrypted text files, located in browser directories which serve to keep a record in your computer or mobile device that you have visited this website. 11. Retention of Data
